Terms and Conditions

1. Acceptance of Terms
By accessing or using the CoffeePass platform, website, or any associated services provided by Coffeepass (Pty) Ltd (“CoffeePass”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.
These terms apply to all users of the CoffeePass platform, including members, partner café representatives, and visitors to mycoffeepass.app.
2. Service Description
CoffeePass is a café-discovery and membership platform that connects members with participating café partners. A paid membership provides member pricing (a discount) on eligible drinks at participating cafés. CoffeePass is not a café and does not sell coffee; cafés are independent businesses, and the discount is provided by the participating café.
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with reasonable notice where practicable.
3. Membership and Subscriptions
CoffeePass membership is offered in tiers on a monthly or annual subscription basis. The current price and benefits of each plan are shown in the app before you purchase.
- —Each tier provides a percentage discount on eligible espresso-based drinks at participating cafés, subject to the daily and per-café redemption limits shown for that tier in the app.
- —Discounts apply only to eligible drinks, have no cash value, are personal and non-transferable, and cannot be combined with other offers unless stated.
- —Subscriptions are sold and billed through the Apple App Store or Google Play and renew automatically at the then-current price until you cancel.
- —You manage and cancel your subscription through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- —Where a free trial is offered, it converts automatically to a paid subscription at the applicable price unless you cancel before the trial ends.
- —We may adjust pricing; changes apply to future billing periods, with notice as required by law and app-store rules.
Because subscriptions are purchased through the app stores, refunds and cancellations are governed by Apple’s and Google’s policies and should be requested from the relevant store. Except where required by law, including the Consumer Protection Act, 2008, membership fees are otherwise non-refundable. Nothing in these Terms limits any right you have that cannot lawfully be limited.
4. User Accounts
You must be at least 18 years old and able to enter into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account at support@mycoffeepass.app.
You must provide accurate and complete information when creating your account and keep this information up to date.
5. Acceptable Use
You agree not to use the CoffeePass platform to:
- —Violate any applicable laws or regulations
- —Attempt to circumvent, manipulate, or abuse the membership, redemption, or discount system
- —Share, resell, transfer, or commercially exploit your account, membership, or redemptions
- —Engage in conduct that disrupts or damages the platform or the experience of other members or partner cafés
- —Use the platform in any way not expressly authorised by these Terms
We may limit, suspend, or terminate access, and reverse or void redemptions, for suspected abuse, fraud, or breach of these Terms.
6. Café Participation
Participating cafés, eligible items, and discount availability may change without notice. A café may decline a redemption that does not meet the applicable rules. Cafés are independent businesses; any dispute about a drink or service is between you and the café, and we are not responsible for the products, service, quality, or conduct of any café. 7. Intellectual Property
All content, branding, design, and intellectual property on the CoffeePass platform and website is owned by or licensed to Coffeepass (Pty) Ltd. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the service for its intended personal use. Nothing in these Terms grants you any other rights to use our intellectual property without our express written permission.
8. Disclaimers
The service is provided on an “as is” and “as available” basis without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted or error-free, or that café information and availability are always accurate. Nothing in these Terms excludes any liability that cannot lawfully be excluded, including under the Consumer Protection Act, 2008.
9. Limitation of Liability
To the fullest extent permitted by applicable law, CoffeePass shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform or services.
Our total liability for any claim arising from or related to these Terms or the services shall not exceed the total amount paid by you to CoffeePass in the three months preceding the claim. Some limitations may not apply to you where prohibited by law.
10. Indemnification
You agree to indemnify and hold CoffeePass, its affiliates, officers, employees, and agents harmless from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the platform, your violation of these Terms, or your infringement of any third-party rights, to the extent permitted by law.
11. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. The parties will first attempt to resolve any dispute in good faith by negotiation. If the dispute is not resolved, it shall be subject to the exclusive jurisdiction of the courts of South Africa. Nothing in this clause limits your rights under the Consumer Protection Act, 2008, or your ability to approach a relevant regulator or consumer forum.
12. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages, network or app-store failures, acts of government, or natural events.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, by direct communication. Your continued use of CoffeePass after changes become effective constitutes acceptance of the revised Terms.
